But is that always true? In some situations, monopolies can lead to innovation, efficiency, and even lower costs. The real question isn't whether monopolies are always good or always bad—it's when they help consumers and when they hurt them.


Yes, competition is absolutely essential. It prevents stagnation by driving brokerages to offer better agent commission splits , upgrade marketing technology, and improve client service. Because over 90% of agents are self-employed contractors, the rivalry forces constant innovation to win listings and secure buyers.

However, the real estate market features a paradox where brokers are fierce competitors but also necessary colleagues.

  • Price & Commission Competition: Brokerage firms and agents actively vie for clients by demonstrating superior value and negotiating commission rates. Because price-fixing is strictly illegal under antitrust and competition laws, commission rates are highly market-driven and fluctuate based on housing conditions.

  • The Cooperation Paradox: Despite competing for business, brokers rely heavily on one another. A listing broker needs a rival buying broker to bring a client so the deal can close. This cooperation is facilitated through systems like the Multiple Listing Service (MLS), where competing brokers agree to share commissions to successfully execute a transaction.

  • Structural Hurdles: Economists point out that the real estate market also has elements that limit full competition. For instance, high concentration in certain local markets and standard commission-sharing models have historically kept fees persistently rigid despite technological advancements.
